Profiles of Honor Digital Donor Agreement
The Virginia Profiles of Honor Tour is a project of the Virginia World War I and World War II Commemoration Commission. I understand that one purpose of this project is to digitize and make freely & publicly available the digital surrogates of items owned by members of the public that document Virginians’ experiences in both World War I and World War II.
As the owner of the material described in the online form, I have the legal right to submit these images, and recognize that any additional on-site digitization will be performed by Commission staff and volunteers trained by the Library of Virginia. I also recognize that the documents so presented by me for digitization are aged and fragile and may be damaged in some form or fashion, regardless of the care taken by the Commission representatives. I hereby waive any action for damages that may occur during or following the digitization process against the Virginia World War I and World War II Commemoration Commission or its agents, the Library of Virginia or its agents, or the Commonwealth of Virginia. This waiver also specifically includes any action that may accrue to the benefit of the owner of the material pursuant to the Virginia Tort Claims Act (§§ 8.01-195.1 et seq. of the Code of Virginia).
I also recognize that the Library of Virginia, as the commonwealth’s official archival repository, will be the permanent repository of any digitized items, and its staff will apply professional selection, description, and management best practices to ensure long-term public access to these materials through the Library of Virginia’s online digital platforms or by other methods. Publication or reproduction of any of these digital surrogates will have a credit line naming the Library of Virginia as the source of the digital images.
Digital surrogates of the materials listed on the verso are hereby offered free and clear, and with no restrictions, to the Commission and the Library of Virginia for the purposes stated above.
The donor hereby declares that s/he has the authority to provide item(s) to the Library of Virginia for digitization and future public use.
